Terms of Service

1. Agreement and eligibility
These Terms govern your access to PeakRound AI, including its website, account portal, Windows application, AI assistance, downloads, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. You must be legally able to enter into this agreement and provide accurate account information.
2. The Service
PeakRound AI is a usage-credit and optional subscription tool for interview preparation and authorized technical conversation support. It can process system audio that you are authorized to use, identify questions, and produce AI-generated guidance using recent conversation context and optional read-only excerpts from a source folder you select.
The Service does not submit applications, make decisions for employers or schools, guarantee outcomes, or replace your own judgment.
3. Authorized and acceptable use
You are responsible for obtaining all permissions required to capture or process audio, transcripts, source files, personal information, or confidential information. You may use the Service only where transcription and assistance are permitted.
You must not use the Service to violate law, privacy, confidentiality, intellectual-property rights, employer or school rules, or the rights of another person; to record people without required consent; to facilitate fraud, impersonation, cheating, or deception; to upload malicious code; to bypass security or usage controls; or to reverse engineer or resell the Service except where law expressly permits it.
4. Accounts and security
You are responsible for safeguarding your credentials and connected devices and for activity under your account. Notify us promptly at [email protected] if you believe your account is compromised. Device and usage limits shown for your plan apply to your account.
5. Credits, subscriptions, taxes, and renewal
Current eligible purchases are processed using Stripe Managed Payments and are identified at checkout as “Sold through Link.” For those purchases, Link acts as Merchant of Record under the applicable Link Consumer Terms. A legacy or fallback purchase may instead be serviced by another disclosed payment provider, including Paddle. PeakRound AI remains the developer and supplier that licenses, fulfills, and supports the Service under these Terms.
One-time Quick, Standard, and Power Pack purchases add the minutes shown at checkout to your account credit balance. Purchased credits combine with the balance already on the account and do not expire. Promotional signup credit is separate from a cash purchase, has no cash value, and is limited to one grant per eligible account.
The Unlimited plan renews monthly at the price shown at checkout until canceled. While Unlimited is active, your saved credit balance is preserved and is not consumed. When Unlimited ends, eligible use resumes against the saved balance. The provider identified at checkout or on your receipt handles payment processing, applicable indirect taxes, receipts, and transaction-level billing support.
You may cancel Unlimited at any time through the PeakRound AI billing portal. Cancellation normally stops future renewal while Unlimited access continues through the end of the already-paid billing period. Fair-use, single-concurrent-session, anti-sharing, and technical safeguards apply to Unlimited use.
6. Refunds
Current-period charges are generally non-refundable and are not prorated. Exceptions may apply where required by law, for duplicate or unauthorized charges, for a material failure of the Service, or where Stripe, Link, or another payment provider requires a refund or reversal. The Cancellation and Refund Policy forms part of these Terms.
7. AI output and technical limitations
AI-generated output may be incomplete, inaccurate, delayed, or unsuitable. You must review it and remain responsible for what you say, submit, or do. Content-protection controls reduce ordinary capture exposure but do not guarantee invisibility or exclusion from every recording or capture path.
8. Your content
You retain rights in content you provide. You grant us a limited right to process that content only as needed to operate, secure, support, and improve the Service and to comply with law. You confirm that you have the rights and permissions needed to provide it. Selected source access is read-only; the Service does not expose a write endpoint for your selected source folder.
9. Availability and changes
We may update, suspend, or discontinue parts of the Service for maintenance, security, legal, provider, or product reasons. We do not promise uninterrupted availability. If a material change adversely affects an active paid plan, any remedy will be determined under applicable law and the refund policy.
10. Suspension and termination
We may restrict or terminate access for material breach, unlawful or harmful use, security risk, nonpayment, or provider requirements. Provisions that by their nature should survive termination—including payment obligations, disclaimers, and limitations—will survive.
11. Disclaimers and liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, uninterrupted operation, interview success, admission, employment, or detection avoidance. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
To the maximum extent permitted by law, our aggregate liability arising from the Service will not exceed the amount you paid for the Service during the three months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or lost-opportunity damages where such exclusion is lawful.
